Acceptance and business identity

These Website Terms apply when you access or use www.pinchit.in. If you do not agree with them, do not use the website.

“Pinchit”, “we”, “us” and “our” mean the business operating this website under the Pinchit trading name. The website, contact email and GST information are listed on the business identity page. GST registration does not by itself mean that Pinchit is an incorporated company.

If you use the website for an organisation, you confirm that you are authorised to act for it where you make a request or provide information on its behalf.

The website is general information, not an offer.

The site describes the kinds of problems Pinchit works on, the approach usually taken and selected project examples. It is not technical, legal, financial or other professional advice for your circumstances, and it is not a binding offer, quote, guarantee or promise of a particular result.

We aim to keep the site accurate and useful, but a page may become incomplete or out of date. Verify information that matters to a decision with us in writing.

An enquiry starts a conversation, not an engagement.

Submitting an email address or phone number authorises us to use it to respond to that enquiry as described in the Privacy Notice. It does not create a client relationship, reserve capacity, agree a deadline or require either side to proceed.

The contact form is not a secure channel for confidential, regulated or sensitive information. Do not submit passwords, source code, customer records, financial account details, health information, government identity documents or trade secrets. If a discussion needs confidential material, wait until the parties have agreed an appropriate channel and, where needed, confidentiality terms.

Paid services use separate written terms.

Any paid diagnosis, design, development, automation, installation, support or other work is governed by the proposal, statement of work, service agreement or other written document accepted for that engagement.

That document identifies the legal supplier and client and sets the agreed scope, deliverables, assumptions, fees, taxes, payment terms, client-data roles, security requirements, intellectual-property treatment, confidentiality, dependencies, warranties, liability and termination rights. Pinchit’s public starting position is described in the Client Data & Project IP Policy. If either page conflicts with the signed engagement document, the signed document controls.

Use the website lawfully and without interference.

You may view and share links to public pages for lawful business and personal use. You must not:

  • attempt to bypass security, probe for vulnerabilities without written authorisation, or disrupt the site;
  • send malware, abusive automated traffic, spam or fraudulent form submissions;
  • misrepresent your identity or authority when contacting us;
  • scrape, reproduce or reuse substantial site content in a way that infringes rights or creates a misleading association; or
  • use the site for unlawful, harmful or deceptive activity.

We may restrict access or take proportionate protective action where reasonably necessary to secure the website or respond to misuse.

Website content and intellectual property

Unless stated otherwise, the website’s text, visual design, graphics, logo, code and original materials are owned by or licensed to Pinchit and are protected by applicable intellectual-property law.

No right to use the Pinchit name or marks is granted except to identify or link to the business accurately. Short quotations and links are welcome where lawful, attributed and not misleading. Permission is required for substantial copying, republishing, resale, modification or creation of a confusingly similar presentation.

Client deliverables and pre-existing materials are dealt with separately in the relevant engagement agreement.

Third-party services and links

The website relies on third-party hosting, analytics and operational providers and may link to external sites. We do not control external content, availability or practices and do not endorse a third party merely by linking to it. Your use of an external service is governed by its own terms and notices.

Availability, warranties and liability

The public website is provided on an “as available” basis. To the extent permitted by law, we do not promise uninterrupted access or that every item will always be complete, current or free from error.

To the extent permitted by applicable law, Pinchit is not liable for indirect or consequential loss arising solely from use of, inability to use, or reliance on this public website. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or wilful misconduct, or removes mandatory consumer rights.

Liability connected with paid services is governed by the applicable engagement agreement, not this website clause.

Applicable law, severability and changes

These Website Terms are governed by the laws of India. Courts and forums with jurisdiction under applicable law may hear disputes. Any mandatory rights or remedies available under consumer or other applicable law remain unaffected.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent possible. A delay in enforcing a provision is not a waiver.

We may update these Terms when the website or legal requirements change. The effective and updated dates at the top identify the current version. Changes apply prospectively from publication.
